Divorce: An Overview 

Divorce is a court sanctioned dissolution of marriage. A variety of issues can arise during the process, which can be complex or simple. When the parties are unable to agree on how to resolve matters, the court will enter orders outlining the details of the divorce. This can include alimony payments, child support obligations, and determining where children will live. Assets and other property interests are divided, and any debts the parties have acquired will be ordered paid by one party or the other, or might be separated by dollar amount.

Fault vs. No Fault Divorce

In many cases a divorce is granted without the requirement that one party prove that the other was at fault. But there are situations where grounds for divorce are set forth in the divorce petition, placing fault on the other party. Some common grounds include:

  • An 18-month separation, where reconciliation is not possible

  • Irreconcilable differences
  • Imprisonment of one spouse

It is not necessary, however, to make a claim of fault when filing. The court will grant a divorce on a no fault basis as well. No fault means there is no finding of fault on either side, and the divorce is granted without the need to establish liability.

Amicable vs. Contested Divorce

In an amicable, uncontested divorce, the issues requiring resolution are easily agreed upon by the parties and there is no need to litigate matters by presenting conflicting points of view with supporting evidence. In a contested case, the parties are not able to agree on things and will each present evidence in support of their position.

Many divorces become contested when parents are unable to agree on custody and parenting time or when assets are being hidden in an effort to shortchange one of the parties. A contested divorce can require extensive discovery, including depositions and witness interviews.
