The New Jersey Law Journal states that the statute was revised to read, "Cohabitation involves a mutually supportive, intimate personal relationship in which a couple has undertaken duties and privileges that are commonly associated with marriage or civil union but does not necessarily maintain a single common household." In other words, a judge will consider factors including:

  • Whether your ex and their new partner are in a relationship that is recognized by friends and family
  • The two have intertwined finances, such as joint credit cards or bank accounts
  • The couple shares rent or other day-to-day living expenses
