In the State of New Jersey, unless otherwise posted, speed limits are as follows:

1) 25 mph in any business or residential district

2) 35 mph in any suburban business or residential district

3) 50 mph in all other locations

If you receive a speeding violation in the state of New Jersey, motor vehicle points will be assessed against your license.  For speeds not exceeding 14 mph over the speed limit, 2 points are assessed.  For speeds between 15 and 29 mph over the limit, 4 points are assessed. For speeds in excess of 30 mph, 5 motor vehicle points are assessed.  This could also result in an increase in your insurance costs and state surcharges being imposed upon the accumulation of 6 motor vehicle points.

It is important to consult with an experienced Municipal Court attorney in order to understand your rights and expectations throughout the municipal court process.  The Law Offices of Jeffrey W. Goldblatt have been representing individuals in Municipal Court who receive speeding and other traffic violations for over thirty five years.  Recently, Mr. Goldblatt represented a Defendant in Edison Township Municipal Court.  Mr. Goldblatt requested discovery from the State including radar certifications verifying that the radar device was in proper working order and administered properly on the date in question by the police officer.  Persistence paid off.  The municipal prosecutor was unable to provide the necessary and required discovery on the scheduled Court date as well as on two following Court appearances.  As a result, upon motion of Mr. Goldblatt, the Court completely dismissed the speeding violation against his client.

Had the Defendant accepted a plea offer from the State,it would have resulted in his client receiving zero motor vehicle points. However, he still would have had to pay substantial fines.  Because of Mr. Goldblatt’s insistence that the State provide the necessary discovery before the case could move forward, he was able to obtain a most favorable result for his client by having the charge dismissed with no fines or penalties imposed.

Of course, results vary from case to case.  Past results cannot guarantee future outcomes.  Each case rests upon its own individual set of facts and circumstances.
